This Domain Registration Agreement applies to domain name registration, renewal, transfer and management services provided by iShout Hosting & IT.
By registering, renewing, transferring or managing a domain name through iShout Hosting & IT, you agree to this agreement, our Terms of Service, and any applicable rules set by the relevant domain registry, registrar or governing body.
1. Registration Obligations
You agree to provide accurate, complete and up-to-date information when registering or managing a domain name through our services.
This may include:
- Your legal name or business name
- Your ABN, ACN or other eligibility details where required
- Registrant contact information
- Administrative contact information
- Technical contact information
- Billing contact information
- Email address, phone number and postal address
You are responsible for ensuring this information remains accurate and for updating it promptly if your details change.
2. Domain Name Licence
When you register a domain name, you are granted a licence to use that domain name for the registration period, subject to the rules of the relevant registry, registrar and governing body.
Domain names are not owned in the same way as physical property. Your right to use a domain name depends on meeting the registration requirements, maintaining accurate details, paying renewal fees, and complying with all applicable policies.
For .au domain names, you must meet the relevant Australian presence, eligibility and allocation requirements for the entire time you hold the domain name licence.
3. .au Domain Eligibility
If you register a .au domain name, including domains such as .com.au, .net.au, .org.au or .au, you must meet the eligibility rules set by auDA and the relevant registry policies.
For example, some .au domain names may require a valid Australian business, company, organisation, trade mark, ABN, ACN or other accepted eligibility basis.
You are responsible for ensuring that you are eligible to register, renew and continue holding your chosen domain name.
4. Renewals
You are responsible for renewing your domain name before it expires.
iShout Hosting & IT may send renewal reminders as a courtesy, but we are not responsible if you fail to receive, read or act on a renewal notice.
Failure to renew a domain name on time may result in suspension, cancellation, expiry, additional recovery fees, or permanent loss of the domain name.
Some expired domain names may enter a grace period or redemption period, but recovery is not guaranteed and may involve additional fees.
5. Transfers
You may request to transfer a domain name to or from iShout Hosting & IT, subject to the rules of the relevant registry, registrar and domain extension.
Domain transfers may require authorisation codes, registrant approval, payment of outstanding invoices, confirmation of eligibility, or completion of registry requirements.
For .au domain names, the person or entity receiving the domain name licence must be eligible to hold that domain at the time of transfer.
6. WHOIS and Public Registration Information
Domain registries and registrars may collect and publish certain domain registration information through WHOIS or other domain lookup services.
Depending on the domain extension and applicable rules, this may include registrant, administrative, technical or contact information.
Some domain extensions may support privacy protection or redaction services, but not all information can always be hidden where disclosure is required by law, registry policy or administrative process.
7. Domain Privacy Protection
Where available, domain privacy protection may be offered to reduce the amount of personal information publicly visible in WHOIS records.
Domain privacy protection is subject to availability, registry rules, registrar policies and the type of domain name registered.
iShout Hosting & IT does not guarantee that privacy protection will be available for every domain extension.
8. Customer Responsibilities
You are responsible for:
- Choosing a domain name that you are legally entitled to use
- Ensuring your domain name does not infringe another party’s rights
- Maintaining accurate registrant and contact information
- Meeting all eligibility requirements for the domain name
- Paying registration, renewal, transfer and recovery fees on time
- Keeping your account login details secure
- Responding promptly to domain verification or registry requests
9. Domain Disputes
Domain name disputes are handled according to the policies of the relevant registry, registrar, dispute resolution provider or governing body.
You agree to comply with any applicable dispute resolution process relating to your domain name, including processes for trade mark disputes, eligibility complaints, registrant disputes or misuse complaints.
iShout Hosting & IT is not responsible for resolving ownership, eligibility, trade mark or legal disputes between you and another party.
10. Suspension, Cancellation or Refusal
A domain name registration, renewal or transfer may be suspended, cancelled, refused or restricted if:
- You provide false, incomplete or inaccurate information
- You fail to meet eligibility requirements
- You fail to pay applicable fees
- You breach this agreement or our Terms of Service
- The domain is used for illegal, abusive, harmful or fraudulent activity
- A registry, registrar, regulator, court or authority requires action
- The domain becomes subject to a dispute, complaint or compliance issue
iShout Hosting & IT may also refuse to register, renew or manage a domain name where doing so would create legal, technical, operational or reputational risk.
11. Third-Party Registrars and Registries
Domain names are registered through third-party registrars and registry operators. Their terms, policies and technical systems may apply to your domain name.
You agree to comply with all applicable registrar, registry and governing body requirements.
iShout Hosting & IT is not responsible for delays, outages, decisions, cancellations, suspensions, policy changes or errors caused by third-party registrars, registries or governing bodies.
12. Limitation of Liability
To the maximum extent permitted by law, iShout Hosting & IT is not liable for loss, damage, business interruption, loss of income, loss of reputation, loss of traffic, loss of data or other consequences arising from domain expiry, suspension, cancellation, transfer failure, registry action, registrar action, DNS issues or failure to renew a domain name.
You are responsible for monitoring your domain status, renewal dates, contact details and eligibility requirements.
13. Changes to This Agreement
We may update this Domain Registration Agreement from time to time to reflect changes to our services, business operations, registry rules, registrar requirements, legal obligations or industry practices.
Updated versions will be published on our website. Continued use of our domain registration services after changes are published means you accept the updated agreement.
